Shared Fence Replacement in Sacramento: A Planning Checklist Before Work Starts

The old fence is not automatically the legal boundary

An existing fence may have been placed for convenience, shifted during earlier work or built without a current survey. A contractor can measure and build a fence, but does not establish a legal property line. If location is uncertain or disputed, resolve it with appropriate title records and a qualified survey professional before demolition.

California Civil Code Section 841 addresses adjoining landowners and boundary fences, but its notice, benefit and cost-sharing rules are fact-specific. Review the current statute and obtain legal advice when there is a dispute; a construction estimate is not a legal determination.

Agree on the visible design from both sides

A “good-neighbor” fence commonly alternates or balances the finished appearance, but the phrase does not define one universal assembly. Agree in writing on height, board orientation, cap, trim, stain, lattice, post material and which side receives gates or hardware. HOA rules or local zoning may affect the design, especially in front or street-side yards.

Plan access before pricing labor

Ask how crews will reach the fence line, where demolished material will leave the property and who temporarily moves plants, sheds or irrigation. Narrow side yards, pools and finished landscaping can change the method and cost. Mark private utilities and irrigation; use the required utility-location process for public underground lines before digging.

Define the gate and grade conditions
